These Terms and Conditions (“Terms”) apply to your use of the My XO Adventures website and to tours, experiences, and related services booked with My XO Adventures LLC (“My XO Adventures,” “we,” “us,” or “our”). By booking a tour, using our website, or providing your information to us, you agree to these Terms. Please read them together with our Privacy Policy.

1. Introduction

My XO Adventures LLC provides private, guided tours in the Black Hills, Badlands, Devils Tower, Spearfish Canyon, Mount Rushmore, and the surrounding region of South Dakota and nearby areas. Our tours are privately guided experiences arranged for you and your group.

We may update these Terms from time to time. The version posted on this page with the “Last updated” date above is the version that applies. Continued use of our website or services after an update means you accept the updated Terms.

2. Tour Bookings and Confirmations

Full payment is required at the time of booking unless My XO Adventures provides a different written payment arrangement for a specific booking. Custom tours, private arrangements, and manually arranged bookings also require full payment unless My XO Adventures provides a different written agreement. Your tour is not confirmed until payment is completed and confirmation is issued by My XO Adventures or our booking system.

4. Cancellations, Refunds, and Rescheduling

Because our tours are privately guided and reserved specifically for your group, and unless a different written policy is provided for a specific booking, the following cancellation and refund schedule applies (measured from the tour start date):

If My XO Adventures cancels a tour for any reason, the guest will receive a full refund for that tour.

Rescheduling is subject to availability and may not always be possible. Approved rescheduling requests are subject to a $175 rescheduling fee per tour, per reschedule. Requests made close to the tour date may be treated as a cancellation if we are unable to reschedule the tour. My XO Adventures may make case-by-case exceptions, but exceptions are not guaranteed and do not change the policy for future bookings.

We assign guides on a 60-day schedule, so late cancellations affect our company, our guides, and their families. If you would like protection against unexpected changes, see Travel Protection (Section 11).

To cancel or request changes, contact My XO Adventures as early as possible at 605-252-9100 or info@myxoadventures.com. Refunds are issued to the original payment method and may take several business days to appear.

5. Weather, Safety, and Itinerary Changes

Tours operate in natural outdoor environments, and weather, road conditions, wildlife activity, park access, and other conditions can change quickly. For guest safety and tour quality, My XO Adventures may adjust the route, timing, stops, or itinerary of a tour when conditions require it.

While the Black Hills are generally pleasant, the region can experience rain, snow, wind, and periods of smoke from distant wildfires. We do not cancel outings for rain, snow, smoke, or wind before or during an adventure unless we believe the roadways are unsafe.

If My XO Adventures determines that a tour cannot safely or reasonably operate and My XO Adventures cancels the tour, the guest will receive a full refund for that tour.

Decisions about safety, including whether to begin, pause, shorten, or end a tour, are made at the discretion of your guide.

Badlands Sunset and Night Sky Weather Practice

For the Badlands Sunset and Night Sky Tour, star viewing depends on weather and sky conditions in and around Badlands National Park. The night before the tour, My XO Adventures reviews the weather forecast and sky conditions. If cloud cover or weather may interfere with night sky viewing, we may notify the guest and explain the possible impact.

On the morning of the tour, we review the forecast again. If cloud cover or weather may make star viewing unlikely, we contact the guest by text, phone, or both and explain the current forecast. The guest may then choose either:

When My XO Adventures offers this weather-based conversion option, it is not treated as a guest rescheduling request and the $175 rescheduling fee does not apply.

This choice is offered so the guest can decide which experience they prefer based on the forecast. If the guest chooses either option and the tour operates, refunds are not provided solely because stars, clear skies, wildlife, sunset color, or other natural conditions do not meet expectations. Rare exceptions may be handled at the discretion of My XO Adventures.

6. Guest Responsibilities

By booking a tour, you agree that you and your group will:

We may decline service to, or end a tour for, any guest whose conduct is unsafe, unlawful, or disruptive, or who is impaired in a way that affects safety.

Guests may be asked to complete a waiver before the tour. The standard waiver may include permission for My XO Adventures and its guides to take photos or video during the tour, share those photos with the guest, and use photos or video for My XO Adventures marketing, website, social media, or related business purposes.

If a guest signs the standard waiver granting photo permission, My XO Adventures may use those photos or video without additional notice or separate approval.

Guests who do not want photos or video taken or used may request the no-photo waiver option before the tour. When a no-photo waiver is completed, My XO Adventures will note that preference for the guide. Depending on the request, guides may avoid taking photos entirely or avoid taking photos of the guest with a My XO Adventures or guide camera.

10. Gift Certificates

Gift Certificates are transferable between clients and do not expire. They may be used toward tour payments and guide tips. Gift Certificates cannot be redeemed for cash at any time.

11. Travel Protection

We highly recommend that guests purchase travel protection before their trip to protect against unforeseen circumstances. Travel protection can help cover trip cancellations and interruptions, travel delays, medical expenses, emergency assistance, cancelled flights, and lost or delayed baggage.

Accidents, injuries, illness, flight delays, weather, natural events, and other unexpected circumstances can lead to cancellations within our cancellation periods. Without travel protection, these events can result in the loss of the amount paid under the cancellation schedule in Section 4.

12. Text Messaging Terms

By providing your phone number and choosing to receive text messages from My XO Adventures, you agree to receive SMS messages related to your inquiry, booking, tour logistics, pickup details, schedule changes, weather updates, waiver reminders, and guest support.

Message frequency varies depending on your inquiry, booking, and tour activity.

Message and data rates may apply.

You may opt out at any time by replying STOP. After you reply STOP, you may receive one final confirmation message.

Consent to receive text messages is not a condition of purchasing a tour from My XO Adventures.

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or your tour will be brought exclusively in the state or federal courts located in Pennington County, South Dakota, and you consent to the jurisdiction of those courts.
